Terms & Conditions — Set Apart Faith-Based Apparel

1. Introduction

Welcome to Set Apart Faith-Based Apparel.

These Terms & Conditions govern the use of our website and the purchase of products from Set Apart Faith-Based Apparel. By using our website or placing an order, you agree to these terms, subject to your rights under applicable law.

2. Products and descriptions

We aim to display our children's clothing, T-shirt designs, colours, sizes, and product descriptions as accurately as possible.

Actual colours may appear slightly different depending on your screen, device, lighting, or display settings.

Please review the available product information and sizing options before placing an order. If you are unsure about sizing or a product, contact us before purchasing.

We will make reasonable efforts to keep product information accurate and current. If an error affects an order, we will communicate with the customer and address the issue fairly and in accordance with applicable law.

3. Product availability

All products, sizes, and colours are subject to actual availability.

Placing an item in your cart does not necessarily reserve that item.

If a product becomes unavailable after an order is placed, we will contact the customer to explain the situation and discuss appropriate options. Any cancellation or refund will be handled in accordance with applicable consumer protection law.

We will not knowingly represent an unavailable product as available.

4. Prices and payment

Product prices will be displayed on the website before checkout.

Any applicable delivery charges and other mandatory costs must be disclosed before the customer completes the purchase.

Payment must be completed using the payment methods actually offered at checkout.

An order confirmation does not, by itself, mean that payment has been successfully received. Payment status is determined by the relevant payment provider and our verified transaction records.

If a genuine pricing or technical error occurs, we will communicate with the customer and handle the matter fairly and in accordance with applicable law.

We will not claim that an order has been paid for unless the payment has been verified.

5. Orders and order confirmation

Customers are responsible for providing accurate contact information, delivery details, product selections, sizes, colours, and quantities.

After an order is submitted, the customer should receive an order confirmation when the website's order system supports it.

If we cannot fulfil an order, we will communicate with the customer and explain the available options. Where a refund is legally required, it will be handled in accordance with applicable law.

We reserve the right to investigate suspected fraudulent activity and to take reasonable steps to protect customers and the business, subject to applicable law.

6. Delivery and shipping

Available delivery methods, delivery areas, estimated delivery times, and shipping charges must be displayed at checkout or in the applicable delivery information.

Delivery estimates are provided as guidance and may be affected by circumstances outside our reasonable control.

Customers must provide a complete and accurate delivery address and contact number.

If a delivery is delayed, unsuccessful, or affected by incorrect information, please contact hello@setapartapparel.co.za so that we can investigate.

We will comply with applicable legal obligations regarding delivery, non-delivery, cancellations, and refunds.

No specific delivery fee or delivery timeframe is guaranteed by these terms unless it has been expressly stated and confirmed for the relevant order.

7. Returns, exchanges, refunds, and defective products

We want customers to be satisfied with their purchases.

If you receive an incorrect, damaged, defective, or materially misdescribed product, contact hello@setapartapparel.co.za with your order reference and a description of the issue. Photographs may be helpful when explaining damage or defects.

We will assess the matter and explain the next steps.

Returns, replacements, exchanges, repairs, and refunds will be handled in accordance with the applicable South African Consumer Protection Act, Electronic Communications and Transactions Act, and other relevant laws.

Nothing in these terms removes or limits a consumer right that cannot lawfully be excluded.

Different rules may apply depending on whether a product is defective, incorrect, unwanted, customised, or otherwise covered by a specific legal right.

Where a cooling-off right applies under applicable law, the customer may exercise that right subject to the applicable legal requirements.

Customers should contact us promptly when an issue arises so that we can assist.

8. Children's clothing and garment care

Our products are intended to be worn according to their design, size, and applicable garment care instructions.

Customers should check the size information and garment care label before use or washing.

General care recommendations may include washing similar colours together, turning printed shirts inside out before washing, using suitable detergent, and avoiding direct ironing over printed designs.

The care label supplied with the actual garment takes precedence over general care suggestions on the website.

Parents and guardians are responsible for choosing appropriate sizes and supervising children according to the garment's intended use.

9. Website use

Customers agree to use the website lawfully and not to interfere with its operation, attempt unauthorised access, misuse its services, or submit knowingly false or fraudulent information.

We may take reasonable steps to protect the website, customers, and business from misuse, subject to applicable law.

We aim to keep the website available and functioning correctly, but uninterrupted availability cannot be guaranteed.

10. Intellectual property

The Set Apart name, logo, original designs, graphics, photographs, text, and other original website content may be protected by applicable intellectual property laws.

Unless permitted by law or authorised in writing, these materials may not be copied, reproduced, distributed, or used commercially without permission from the relevant rights holder.

Purchasing a T-shirt does not transfer ownership of the underlying brand, artwork, or intellectual property.

We use customer information where reasonably necessary to process orders, arrange delivery, respond to enquiries, manage payments, and operate the website.

Personal information must be handled in accordance with applicable privacy legislation, including South Africa's Protection of Personal Information Act (POPIA), where applicable.

Payment information may be processed by the payment provider used at checkout, subject to that provider's terms and privacy practices.

Customers should avoid sending passwords or unnecessary sensitive personal information by email.
